Terms & Conditions

These terms and conditions ("Terms") apply to the Telic app (hereby referred to as "Application") for all supported platforms (including mobile, desktop, and web) that was created by Petr Bína (hereby referred to as "Service Provider"). For support or inquiries, you may contact the development lead, Jonáš Bína, at contact@telic.dev.

Accepting these Terms

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. If you don't agree to all of the terms below, please do not use the Application. Also, if a term does not make sense to you, please let us know by e-mailing contact@telic.dev.

Changes to these Terms

The Service Provider may periodically update their Terms and Conditions. Whenever we make changes to these Terms, the changes are effective 30 days after we post such revised Terms (indicated by revising the date at the top of these Terms) or upon your acceptance if we provide a mechanism for your immediate acceptance of the revised Terms. It is your responsibility to check the Application for changes to these Terms.

If you continue to use the Application after the revised Terms go into effect, then you have accepted the changes to these Terms.

Third-Party Services

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

Your use of such third party applications, websites, and services is governed by that party's own terms of service or privacy policies. We encourage you to read the terms and conditions and privacy policy of any third party application, website or service that you visit or use.

Creating Accounts

When you create an account or use another service to log in to the Application, you agree to maintain the security of your password and accept all risks of unauthorized access to any data or other information you provide to the Application.

If you discover or suspect any Application security breaches, please let us know as soon as possible.

Payment Terms & Refunds

Payment Processing

All payments and in-app purchases for the Application are processed by the respective platform providers:

  • For iOS users: Apple Inc. through the Apple App Store
  • For Android users: Google LLC through Google Play Store

The Service Provider does not directly process, store, or have access to your payment information. All billing, payment processing, and transaction management are handled exclusively by Apple or Google.

Subscriptions

The Application offers subscription-based features. By subscribing, you agree to the following:

  • Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period.
  • Billing Timing: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage your subscription and turn off auto-renewal by going to your Account Settings on the App Store (iOS) or Google Play Store (Android) after purchase.
  • No Refunds: Unused portions of a free trial period, if offered, will be forfeited when you purchase a subscription.

IMPORTANT: Account Deletion & Subscriptions

Deleting your account in the App or uninstalling the App DOES NOT cancel your subscription.

Your subscription is a contract between you and the Store (Apple App Store or Google Play Store). You must cancel your subscription in your phone's settings to stop future charges. The Service Provider cannot cancel subscriptions on your behalf.

Refund Policy

Refund requests must be made directly to the platform provider (Apple or Google), not to the Service Provider. The Service Provider cannot process refund requests.

  • Apple App Store: Refund eligibility is determined by Apple's refund policy. To request a refund, visit https://reportaproblem.apple.com or contact Apple Support. Refund decisions are typically made within 48 hours.
  • Google Play Store: For purchases made within 48 hours, you may request a refund through Google Play. After 48 hours, refund eligibility is determined by Google's policies and the developer may be contacted. To request a refund, visit https://play.google.com/store/account or contact Google Play Support.

The Service Provider is bound by the platform providers' refund policies and decisions. Any approved refunds will be processed by Apple or Google according to their standard procedures. Developer-issued refunds are not available; refunds are processed exclusively by the platform provider.

Platform Terms Precedence

With respect to payments, billing, subscriptions, and refunds, the terms of service of the respective platform provider (Apple or Google) shall take precedence over any conflicting terms in this Agreement. Users are encouraged to review:

Data Storage and Backup

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. Your data is stored as follows:

  • Local Storage on Device: Your productivity data and Google Account ID are stored locally on your device. This data is NOT encrypted on the local device.
  • Backup and Sync: When you sync your data, backups are replaced with the latest version from your device. Only the current state of your data is maintained; previous versions are not retained in backups.
  • Google Drive Integration: You may optionally sync your productivity data to your personal Google Drive account at your discretion. This data is stored in YOUR Google Drive account, not on the Service Provider's servers.

It is your responsibility to maintain the security of your device (phone, tablet, or computer) and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your device, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your device to malware, viruses, malicious programs, compromise your device's security features, and may result in the Application not functioning correctly or at all.

User Conduct and Responsibilities

You agree not to:

  • Use the Application in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Application or that could damage, disable, overburden or impair the functioning of the Application;
  • Impersonate or post on behalf of any person or entity or otherwise misrepresent your affiliation with a person or entity;
  • Use the Application for any unlawful or fraudulent purposes;
  • Circumvent or attempt to circumvent any filtering, security measures, rate limits or other features designed to protect the Application, users of the Application, or third parties.

Service Availability and Limitations

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

Updates and Termination

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you.

The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. If you breach any of these Terms, we have the right to suspend or disable your access to or use of the Application. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

Intellectual Property Rights

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

Disclaimer and Limitation of Liability

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

Indemnification

You agree to defend, indemnify and hold us harmless from and against any and all costs, damages, liabilities, and expenses (including attorneys' fees, costs, penalties, interest and disbursements) we incur in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party relating to your use of the Application or the use of the Application by any person using your account, including any claim that your use of the Application violates any applicable law or regulation, or the rights of any third party, and/or your violation of these Terms.

Governing Law

The validity of these Terms and the rights, obligations, and relations of the parties under these Terms will be construed and determined under and in accordance with the laws of the Czech Republic, without regard to conflicts of law principles.

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with the Application or relating to your use of it, resides in the courts of the Czech Republic and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Czech Republic in connection with any such dispute including any claim involving Application. You further agree that you and Service Provider will not commence against the other a class action, class arbitration or other representative action or proceeding.

Entire Agreement

These Terms constitute the entire agreement between you and Petr Bína regarding the use of the Application, superseding any prior agreements between you and Petr Bína relating to your use of the Application.

Feedback

Please let us know what you think of the Application, these Terms and, in general, Telic. When you provide us with any feedback, comments or suggestions about the Application, these Terms and, in general, Telic, you irrevocably assign to us all of your right, title and interest in and to your feedback, comments and suggestions.

Note: Certain application stores (e.g., Apple App Store, Google Play, etc.) may require you to include additional terms and conditions in these Terms of Service as a condition to making your application available on such platform. If applicable, review your agreement with any such application store to determine if additional terms are required.
